The Modev8™ Shop is operated by The Motor Development Co., LLC d/b/a Modev8™ (“Modev8,” “we,” “us,” or “our”).
By using this website or placing an order through the Modev8™ Shop, you agree to these Terms & Conditions and the policies referenced within them.
Our Merchandise
Modev8™ is a motor development company, not a traditional clothing manufacturer or retailer. Our merchandise gives the people who believe in what we are building a way to represent Modev8™ while supporting the continued growth and reach of Tuned Motor Development®.
Most Modev8™ merchandise is made to order. Rather than maintaining a traditional inventory of finished merchandise, products are generally produced specifically after an order is placed.
Because products are made to order, certain restrictions regarding cancellations, exchanges, and returns apply. Please review our Refund & Returns Policy before completing your purchase.
Product Information
We make reasonable efforts to display product descriptions, images, colors, sizing information, and other product details as accurately as possible.
However, colors may appear differently depending on your screen or device, and minor variations may occur between product images and finished merchandise. Fit and sizing may also vary between different garment manufacturers, styles, and products.
Customers are responsible for reviewing available product information and selecting the appropriate product, size, and color before placing an order.
Orders
Submitting an order does not necessarily guarantee acceptance of that order.
We reserve the right to refuse or cancel an order when reasonably necessary, including in cases involving suspected fraud, payment problems, product availability, technical errors, incorrect pricing, or other circumstances that prevent us from fulfilling the order as intended.
If we cancel an order after payment has been collected, the appropriate amount will be refunded.
Pricing and Payment
Prices are displayed in U.S. dollars unless otherwise indicated.
Prices, products, promotions, and availability may change without notice.
Applicable shipping charges and taxes, when required, will be displayed or calculated during checkout.
Payment must be successfully authorized before an order can be processed.
If a product is accidentally listed at an incorrect price because of a typographical, technical, or other error, we reserve the right to correct the error or cancel the affected order. If payment has already been collected for a canceled order, it will be refunded.
Made-to-Order Production
Modev8™ merchandise may be produced and fulfilled by third-party production partners, including Printful and similar print-on-demand providers.
When an order is submitted for production, manufacturing may begin quickly. Because the merchandise is being produced specifically for that order, we cannot guarantee that an order can be changed or canceled after it has been placed.
Please review your order carefully before completing checkout.
Shipping and Delivery
Shipping costs and available delivery options are provided during checkout when applicable.
Delivery dates and shipping times are estimates and are not guaranteed. Production and delivery may be affected by circumstances outside our reasonable control, including carrier delays, weather, supply availability, incorrect delivery information, or other disruptions.
Customers are responsible for providing an accurate and complete shipping address when placing an order.
If you discover an error in your shipping information, contact us as soon as possible at info@modev8.com. We cannot guarantee that an address can be changed after an order has entered production or shipment.
Returns, Refunds and Exchanges
Because Modev8™ merchandise is generally made to order, merchandise sales are subject to our separate Refund & Returns Policy.
Made-to-order merchandise generally cannot be returned or exchanged because of incorrect size or color selection, buyer preference, or change of mind.
Damaged, defective, misprinted, or incorrectly fulfilled merchandise will be handled according to our Refund & Returns Policy.
Please review that policy before placing your order.
Third-Party Services
We use third-party providers to operate portions of our website, process payments, manufacture merchandise, fulfill orders, and provide shipping and other services.
These may include ecommerce providers, payment processors, Printful, shipping carriers, website hosting providers, and other service providers.
We are not responsible for interruptions, delays, outages, or other issues caused solely by third-party services that are outside our reasonable control.
Intellectual Property
The Modev8™ name, logos, artwork, merchandise designs, website content, graphics, photographs, written materials, and other original content displayed through this website are protected by applicable intellectual property laws and may not be reproduced, distributed, sold, modified, or commercially used without authorization.
Tuned Motor Development® and its associated branding and materials are protected intellectual property.
Nothing contained on this website grants permission or a license to use Modev8™ or Tuned Motor Development® intellectual property except as expressly authorized in writing.
Purchasing Modev8™ merchandise does not grant the purchaser ownership of or commercial rights to the designs, trademarks, artwork, or other intellectual property appearing on the merchandise.
Acceptable Use
You agree not to use this website for unlawful or fraudulent purposes or in a manner intended to interfere with the website, its security, its operation, or other users.
You may not attempt to gain unauthorized access to customer accounts, website systems, payment systems, or other restricted portions of the website.
Website Availability and Errors
We work to keep the Modev8™ website and shop accurate and available, but we cannot guarantee uninterrupted or error-free operation.
We reserve the right to correct errors, update information, modify or discontinue products, change pricing, and make changes to the website when reasonably necessary.

To the fullest extent permitted by applicable law, The Motor Development Co., LLC will not be responsible for indirect, incidental, special, or consequential damages arising solely from use of this website, third-party services, shipping delays, or circumstances outside our reasonable control.
